People's Republic of China Energy Conservation Law

Article 2 The term "energy" as used in this Law refers to coal, crude oil, natural gas, electricity, coke, coal gas, heat, refined oil, liquefied petroleum gas, biomass energy and other kinds of energy that are directly or through processing and conversion. Article 3 The term "energy conservation" as used in this Law refers to strengthening energy management, taking technically feasible, economically sound, and environmentally and socially affordable measures to reduce losses and waste from energy production to consumption, and to be more effective. Use energy reasonably. Article 4 Energy conservation is a long-term strategic policy for the country to develop its economy. The State Council and the people's governments of the autonomous regions and municipalities directly under the Central Government shall strengthen energy conservation work, rationally adjust the industrial structure, enterprise structure, product structure and energy consumption structure, promote energy-saving technological progress, reduce energy consumption per unit of output value and energy consumption per unit of product, and improve energy development and processing. Transform, transport and supply, gradually improve energy efficiency, and promote the development of the national economy to energy-saving. The state encourages the development and utilization of new and renewable sources of energy. Article 5 The State formulates energy conservation policies, prepares energy conservation plans, and incorporates them into national economic and social development plans to ensure the rational use of energy and coordinate with economic development and environmental protection. Article 6 The State encourages and supports the research and promotion of energy-saving science and technology, strengthens energy-saving publicity and education, popularizes energy-saving scientific knowledge, and enhances the awareness of energy conservation among the whole people. Article 7 Any unit or individual shall perform its energy conservation obligations and shall have the right to report the act of wasting energy. The people's governments at all levels shall reward the units and individuals that have made outstanding achievements in the research and promotion of energy-saving or energy-saving science and technology. Article 8 The department in charge of energy conservation work of the State Council shall be in charge of the supervision and administration of energy conservation throughout the country. The relevant departments of the State Council are responsible for energy conservation supervision and management within their respective functions and responsibilities. The departments in charge of energy conservation work of local people's governments at or above the county level shall be responsible for the supervision and administration of energy conservation within their respective administrative regions. The relevant departments of the local people's governments at or above the county level shall be responsible for the supervision and management of energy conservation within their respective areas of responsibility. The second chapter can manage Article 9 The State Council and local people's governments at all levels should strengthen their leadership in energy conservation work, and deploy, coordinate, supervise, inspect and promote energy conservation work every year. Article 10 The State Council and the people's governments of the autonomous regions and municipalities directly under the Central Government shall, in accordance with the principle of combining energy conservation and energy development, and putting energy conservation at the forefront, on the basis of technical, economic and environmental comparative arguments for energy conservation and energy development, Energy conservation, energy development investment projects, and energy investment plans. Article 11 The State Council and the people's governments of the autonomous regions and municipalities directly under the Central Government shall arrange energy conservation funds in the capital construction and technological transformation funds to support the rational use of energy and the development of new and renewable energy sources. The municipal and county people's governments shall arrange energy conservation funds according to actual conditions to support the rational use of energy and the development of new and renewable energy sources. Article 12 The feasibility study report of a fixed asset investment project shall include a special argument for the rational use of energy. The design and construction of fixed asset investment projects shall comply with reasonable energy use standards and energy conservation design specifications. Projects that fail to meet the requirements of reasonable energy use standards and energy-saving design specifications shall not be approved for construction by the authorities that have been examined and approved according to law; after the completion of the project, if the requirements for reasonable energy use standards and energy-saving design specifications are not met, the inspection shall not be accepted. Article 13 prohibits the construction of industrial projects that are backward in technology, consume too much energy, and seriously waste energy. The list and specific implementation measures for prohibiting new energy-intensive industrial projects shall be formulated by the department in charge of energy conservation work of the State Council in conjunction with the relevant departments of the State Council. Article 14 The competent department of standardization administration under the State Council shall formulate national standards for energy conservation. For those national standards that do not have the provisions of the preceding paragraph, the relevant departments of the State Council may formulate relevant industry standards for energy conservation according to law and report them to the standardization administrative department of the State Council for the record. The formulation of standards for energy conservation should be technologically advanced, economically sound, and constantly improved and improved.
